Terms & Conditions
One document covering everything: how you may use BluClr, what we do and do not promise, how any platform charge and refund works, and the law that applies.
These Terms & Conditions (“Terms”) form a binding agreement between you and BluClr, which operates the BLUCLR platform (the “Platform”), comprising the BLUCLR mobile application, our website and related services.
By creating an account, accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
BLUCLR is a platform that connects employers and workers. BLUCLR does not employ the workers on the Platform, is not a party to any engagement agreed between users, and does not guarantee employment, worker quality, worker availability or hiring outcomes. BLUCLR does not charge brokerage or commission on worker wages.
A. The agreement
Definitions
- “Platform” means the BLUCLR mobile application, website and related services.
- “User” means any person who accesses or uses the Platform.
- “Worker” means a User who registers to be discoverable for skilled or blue-collar work.
- “Employer” means a User — an individual, business or organisation — who uses the Platform to find and contact Workers.
- “Engagement” means any arrangement, agreement, hiring or work relationship entered into between an Employer and a Worker.
- “Content” means information, text, images and other material submitted to or displayed on the Platform.
What BLUCLR does: the nature of our service
BLUCLR provides a technology platform whose purpose is to help Employers and Workers find and contact each other directly. Specifically:
- Workers may create profiles setting out their skills, experience, location and work preferences.
- Employers may search for skill categories and view the information Workers have chosen to share.
- Both sides may connect and communicate through the Platform, and may then deal with each other directly.
BLUCLR is not an employment agency, labour contractor, staffing company, recruitment consultant or broker acting on behalf of either side. We do not select, supply, supervise, direct or control Workers, and we do not represent Employers in negotiations.
Any Engagement is entered into solely between the Employer and the Worker. BLUCLR is not a party to it, has no obligations under it, and earns nothing from the wages agreed under it.
Eligibility
To use the Platform you must:
- be at least 18 years of age;
- be legally competent to enter into a binding contract under applicable law;
- not be barred from using the Platform under any applicable law, or previously removed from the Platform by us;
- where you register on behalf of a business or organisation, be authorised to bind that entity to these Terms.
The Platform is intended for use in India. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
Account creation and OTP authentication
To use most features you must create an account. Accounts are created and accessed using a mobile phone number, verified by a one-time password (OTP) sent by SMS.
- You must provide a phone number that you own or are authorised to use, and information that is accurate and current.
- Do not share your OTP with anyone. Anyone with access to your phone number and OTP may be able to access your account.
- You are responsible for all activity that takes place under your account.
- You must notify us promptly at info@bluclr.in if you believe your account has been accessed without your authorisation, or if you lose control of the registered phone number.
- One person should maintain one account. Creating multiple or duplicate accounts, or accounts in another person's name, is not permitted.
- Accounts are personal to you and may not be sold, rented or transferred.
SMS and network charges levied by your mobile operator are your responsibility. OTP delivery depends on your operator and network, and we cannot guarantee delivery times.
B. Your responsibilities
Your responsibilities as a User
When using the Platform, you agree to:
- provide information that is true, accurate and not misleading, and keep it up to date;
- use the Platform only for genuine purposes connected with skilled work — finding workers, or finding work;
- comply with all applicable laws in your use of the Platform and in any Engagement you enter into;
- treat other Users with basic courtesy and respect;
- exercise your own judgement before relying on information provided by another User;
- be responsible for your own decisions, including who you engage or whose work you accept.
Employer responsibilities
If you use the Platform as an Employer, you additionally agree that:
- you will describe your requirement accurately, including the nature of the work, its location and its duration;
- you are solely responsible for verifying, to your own satisfaction, the identity, skills, qualifications, eligibility to work, and suitability of any Worker before engaging them;
- you are solely responsible for the terms of any Engagement, including wages, payment terms, working hours, leave, benefits and duration;
- you will pay the Worker the wages you have agreed, in full and on time;
- you are responsible for compliance with all laws applicable to the engagement of workers — including those relating to minimum wages, hours of work, workplace safety, insurance, contract labour, child and forced labour prohibitions, social security contributions and taxes — to the extent they apply to you;
- you will provide a safe place and system of work where the Worker performs work under your direction;
- you will not discriminate unlawfully against any Worker;
- you will not use Worker information obtained through the Platform for any purpose other than considering and conducting a genuine Engagement, and will not sell, publish or transfer it to third parties;
- you will not ask a Worker to pay any money as a condition of being considered for or given work.
Worker responsibilities
If you use the Platform as a Worker, you additionally agree that:
- the skills, experience, trade and other details on your profile are truthful and describe your own abilities;
- you hold any licence, certification or authorisation that the law requires for the work you offer to perform, for example licences that apply to certain electrical or safety-critical work;
- you will honour commitments you make to an Employer, or tell them promptly and honestly if you cannot;
- you are responsible for satisfying yourself about an Employer, the work and the terms offered before accepting;
- you will comply with the reasonable and lawful site rules and safety requirements of the place where you work;
- you will not impersonate another person, or create a profile on someone else's behalf without their knowledge and consent;
- you understand that BLUCLR does not guarantee that you will receive work, enquiries or any particular level of earnings.
Profile accuracy and content standards
Profiles are the basis on which Users decide whether to contact each other, so accuracy matters.
- You must not overstate skills, experience or qualifications.
- You must not upload photographs or material that you do not have the right to use, or that depict another person without their consent.
- You must not include contact details, advertising or content unrelated to the purpose of the Platform in profile fields intended for other information.
- We may, but are not obliged to, review Content. We may remove or ask you to correct Content that appears inaccurate, misleading, unlawful or in breach of these Terms.
BLUCLR does not independently verify User-provided information unless we state otherwise for a specific feature. The presence of a profile on the Platform is not a certification by BLUCLR of that User's skills, honesty or suitability.
Prohibited activities
You must not, and must not permit anyone else to:
- post false, misleading, fraudulent or impersonating information;
- use the Platform for any unlawful purpose, or to facilitate any unlawful act;
- advertise or solicit for anything other than genuine skilled work — including unrelated goods, services, loans, investments or other platforms;
- charge, demand or accept any brokerage, commission, placement fee, registration fee or similar payment from a Worker in exchange for work or the promise of work, whether obtained through the Platform or otherwise;
- engage in or facilitate child labour, forced labour, bonded labour, trafficking or any form of exploitation;
- harass, threaten, abuse, stalk, defame or discriminate against any User;
- collect, scrape, harvest, copy, index or store User data by automated means, or build a competing database from the Platform;
- use bots, crawlers, scripts or other automated means to access the Platform;
- attempt to gain unauthorised access to the Platform, other accounts, or our systems and networks;
- interfere with, disrupt, overload or attempt to reverse engineer or decompile the Platform;
- upload viruses, malware or other harmful code;
- circumvent any access restriction, rate limit or security feature;
- use the Platform to send spam, chain messages or unsolicited commercial communications;
- infringe the intellectual property or privacy rights of BLUCLR or any third party;
- misrepresent your relationship with BLUCLR, or use our name or marks in a way that suggests endorsement.
We take these prohibitions seriously. Breach may result in immediate suspension or termination of your account and, where appropriate, referral to the authorities.
Communication between Users
The Platform enables Employers and Workers to contact each other. When you communicate with another User:
- you do so on your own responsibility and using your own judgement;
- BLUCLR does not participate in, moderate in real time, endorse or verify what is said;
- you should be cautious about sharing sensitive personal information, original documents or financial details;
- you should report abusive or suspicious behaviour to us at info@bluclr.in.
We may store communications made through Platform features for support, safety and legal purposes, as described in our Privacy Policy.
Dealing fairly with the other side
- Agree the work, the wages and the payment schedule clearly, before work starts.
- Employers: pay the agreed wages in full and on time.
- Workers: turn up when you said you would, or tell the employer promptly and honestly if you cannot.
- Do not change agreed terms unilaterally after work has begun.
- Communicate respectfully. Disagreements happen; abuse is not acceptable.
Safety and lawful conduct
- Employers must provide a safe place and system of work, and comply with the safety laws that apply to them.
- Workers must follow reasonable and lawful site rules and safety instructions.
- No User may engage in or facilitate child labour, forced labour, bonded labour, trafficking or any form of exploitation.
- No User may discriminate unlawfully on any ground prohibited by law.
- Do not ask another User to hand over original identity documents, or to surrender them as security.
- Meet in reasonable places and use your judgement. If a situation feels unsafe, walk away and tell us.
Reporting problems to us
Please tell us if you come across:
- a profile that appears fake, impersonating or misleading;
- anyone demanding money in exchange for work;
- abusive, threatening or discriminatory behaviour;
- unsafe working conditions;
- anything that looks like exploitation or trafficking;
- a technical problem or a security concern.
Report to info@bluclr.in, or call us on the number listed on our Contact Us page. Include the account, dates and any messages or screenshots you have. We treat reports of exploitation and safety risks with priority.
C. Engagements, wages and Zero Brokerage
Hiring arrangements and the Employer–Worker relationship
This section is important, and it reflects how the Platform actually works.
- Any Engagement is a direct arrangement between the Employer and the Worker.
- BLUCLR is not the employer, principal employer, contractor, sub-contractor, agent or representative of any Worker or Employer, and nothing on the Platform creates such a relationship.
- BLUCLR does not select or assign Workers to Employers, does not supervise or control the manner in which work is performed, and does not set wages, hours or conditions.
- The Employer and the Worker are responsible for agreeing all terms of the Engagement, and for recording them if they wish to.
- Whether an Engagement constitutes employment, contract work, casual work or any other relationship — and the legal consequences of that characterisation — is a matter between the Employer and the Worker and the law that applies to them. BLUCLR makes no determination on the point.
- All statutory obligations arising from an Engagement rest with the parties to it, not with BLUCLR.
Payments between Employers and Workers, and Zero Brokerage
Wages and payment. Wages, rates, advances, payment method, payment timing and any deductions are agreed directly between the Employer and the Worker. Payment is made directly by the Employer to the Worker. BLUCLR does not collect, hold, route, guarantee or disburse wages, and does not act as an escrow or payment agent for Engagements.
BLUCLR does not charge brokerage, commission, placement fees or any percentage cut on the wages agreed between an Employer and a Worker. No amount is deducted by BLUCLR from a Worker's earnings, and no brokerage is added to what an Employer pays a Worker.
No User may charge a Worker brokerage, commission or a fee in exchange for work or the promise of work obtained through the Platform. If anyone asks you for such a payment, do not pay it and report it to info@bluclr.in.
Access to the Platform. Any charges that may apply to an Employer for access to the Platform itself are separate from, and unrelated to, worker wages. BLUCLR intends to provide Employers with access to the Platform free of charge for an introductory period of three (3) months. After that introductory period, BLUCLR may introduce monthly and yearly subscription plans for Employers. Any applicable price and terms will be disclosed to the Employer before any purchase, and no charge will be made without the Employer's consent. Even where such a plan applies, it is a platform access fee and is not brokerage or commission on worker wages. Full details are set out in our Subscription / Payment Policy and our Refund & Cancellation Policy.
Disputes about payment. If a dispute arises about wages or payment under an Engagement, it is a matter between the Employer and the Worker. BLUCLR is not responsible for non-payment, short payment, delayed payment or any other default by a User, and has no obligation to make good any loss. We may, at our discretion and without any obligation to do so, act on reports of misconduct by restricting or removing an account.
D. Platform access, charges and refunds
Who platform charges apply to
This policy applies to employers who use the Platform to find and connect with workers.
Workers are not charged for using BLUCLR, and no brokerage, commission, placement fee or registration fee is charged to a worker or deducted from a worker's wages. Where this policy refers to subscriptions or payments, it refers only to employer access to the Platform.
Introductory period for employers
BLUCLR intends to provide employers with access to the Platform free of charge for an introductory period of three (3) months.
- The introductory period is intended to let employers use the Platform and judge whether it is useful to them, before any charge arises.
- No payment details are required in order to use the Platform during the introductory period, and no amount will be charged during it.
- How the introductory period is measured — for example from the date an employer account is created, or from a date set by BLUCLR — will be stated in the app at the relevant time.
- BLUCLR may extend, shorten, vary or withdraw the introductory period for future users, or offer it on different terms, at its discretion. Any change will be notified in advance to users to whom it applies and will not create a charge that the user has not agreed to.
After the introductory period
After the introductory period, BLUCLR may introduce subscription plans for employers in order to continue accessing the Platform or certain features of it.
- BLUCLR may offer monthly and yearly subscription options.
- Pricing has not been finalised and is not published here. Applicable prices, the features included, the billing period and the applicable terms will be disclosed clearly in the app before any purchase is made.
- No amount will be charged without the employer's express consent. An employer will need to choose a plan and complete a payment authorisation for any charge to arise.
- If an employer chooses not to subscribe, BLUCLR may limit or discontinue access to paid features. Any effect on account and profile data will be handled in accordance with our Privacy Policy.
- BluClr may also continue to offer some functionality without charge.
Transition from free access to paid access
If and when subscriptions are introduced, employers using the Platform under the introductory period will be treated as follows:
- BLUCLR will give advance notice before the introductory period ends and before any charge could apply. We will give at least 30 days’ notice.
- The notice will state the available plans, the applicable price, the billing period and how to subscribe.
- Free access will not convert automatically into a paid subscription. An employer must actively choose a plan and authorise payment.
- An employer who does not subscribe will simply not be charged; access to paid features may then be limited as described above.
Billing, renewal and taxes
The following will apply to any subscription that BLUCLR introduces. Specific mechanics depend on the payment methods and platforms used and are to be confirmed.
- Billing period. Monthly or yearly, as selected by the employer at the time of purchase.
- Payment methods. Payments will be handled by a licensed payment gateway or by the billing system of the app store from which the app was obtained. The accepted payment methods will be shown at the point of purchase. BluClr does not store full payment card details.
- Renewal. Whether a subscription renews automatically at the end of its billing period will be stated clearly at the point of purchase. Where a subscription does renew automatically, the employer will be able to turn renewal off before the next billing date, and we will give notice of renewal where required by applicable law or app store rules.
- Price changes. Any change to the price of an existing subscription will be notified in advance, and will take effect only from the start of a subsequent billing period. The employer will be able to cancel before the change takes effect.
- Taxes. Prices will be shown inclusive or exclusive of applicable taxes as indicated at the point of purchase. Applicable taxes, including GST where relevant, will be charged in accordance with law.
- Invoices. A receipt or invoice will be made available for each payment.
- App store purchases. Where a subscription is purchased through a mobile app store, that store's billing, renewal, cancellation and refund rules will also apply, and cancellation may need to be carried out through the store's subscription settings.
Failed or overdue payments
If a payment fails or is not completed, BLUCLR may retry the payment in accordance with the payment provider's normal process, notify the employer, and suspend or limit access to paid features until payment is completed. BluClr will not charge more than the amount the employer has authorised.
Platform fees are separate from worker wages
Any subscription fee is a charge for access to the Platform — the software that lets an employer search for and connect with workers. It is not brokerage, commission, a placement fee or a share of wages.
BLUCLR does not charge brokerage or commission on worker wages, and does not deduct any amount from a worker's earnings. This does not change if employer subscriptions are introduced.
Wages remain a matter agreed directly between the employer and the worker, and are paid directly by the employer to the worker. BLUCLR does not collect, hold, route or disburse wages.
How to cancel a subscription
If and when employer subscriptions are available, an employer may cancel at any time. Cancellation routes will be:
- In the app: Settings → Subscription → Cancel.
- Through the app store, where the subscription was purchased through a mobile app store — cancellation must then be carried out in that store's subscription settings, and the store's own rules apply.
- By email: info@bluclr.in, from the email address or with the phone number registered to the account, so that we can verify the request.
We will confirm a cancellation once it has been processed. Please keep that confirmation.
When cancellation takes effect
- Cancellation stops any future renewal of the subscription.
- Unless stated otherwise at the point of purchase, access to paid features continues until the end of the billing period that has already been paid for, and then stops.
- Cancelling a subscription is not the same as deleting an account. If you also want your account and data removed, see Account & Data Deletion.
Refunds: the basis on which they are considered
BLUCLR's final refund terms have not yet been published. This section sets out the basis on which refunds will be handled, with the specific periods and amounts to be confirmed.
- Cooling-off window. Whether a refund window applies after purchase, and its length, will be stated at the point of purchase and in the app store listing.
- Unused portion of a billing period. Whether a pro-rata refund is offered for the unused remainder of a paid period will be stated at the point of purchase.
- Duplicate or incorrect charges. Where an employer has been charged twice for the same period, or charged an amount that was not authorised, BLUCLR will refund the excess once verified.
- Service failure. Where a paid feature was substantially unavailable for a prolonged period due to a fault on our side, BLUCLR will consider a refund or credit in respect of the affected period.
- Charges made in error by BLUCLR. These will be refunded in full.
- Hiring outcomes. A subscription pays for access to the Platform, not for a hiring result. A refund will not normally be available on the ground that an employer did not find a suitable worker, did not receive responses, or was dissatisfied with a worker — because BLUCLR does not guarantee those outcomes (see our Disclaimer).
- Breach of terms. Where an account is terminated for breach of these Terms, a refund will not normally be available.
Nothing in this policy limits any right to a refund that an employer has under applicable consumer protection law.
How to request a refund
To request a refund, write to info@bluclr.in with:
- the phone number registered to the account;
- the date and amount of the payment;
- the payment reference or transaction ID;
- a short explanation of why a refund is being requested.
We aim to acknowledge refund requests within 3 working days and to decide them within 15 working days. We will explain the outcome, and the reason if a request is declined.
How approved refunds are processed
- Approved refunds are made to the original payment method used for the purchase. We cannot refund to a different method or to a third party.
- The time taken for a refund to appear depends on the payment provider and the employer's bank, and is typically 5 to 10 working days after approval.
- Where the purchase was made through a mobile app store, the refund may need to be requested from and processed by that store under its own policy, and BLUCLR may not be able to process it directly.
- Any taxes charged will be refunded in proportion to the refunded amount, in accordance with law.
- BLUCLR does not charge a processing fee for refunds. Any charge levied by a payment provider or bank is outside our control.
Subscription termination by BluClr
BLUCLR may suspend or terminate access, including a paid subscription, where an account is used in breach of these Terms or applicable law, or where necessary to protect users or the public. In such cases a refund will not normally be given.
If BLUCLR discontinues a paid plan or the Platform itself, we will give reasonable advance notice and will refund the unused portion of any prepaid period, calculated on a pro-rata basis.
E. Disclaimers and liability
Platform limitations and the absence of guarantees
You acknowledge and agree that BLUCLR does not guarantee, represent or warrant:
- that an Employer will find a suitable Worker, or that any Worker will be available;
- that a Worker will receive any enquiry, any work, or any level of earnings;
- the accuracy, completeness or truthfulness of information provided by any User;
- the identity, skills, qualifications, character, conduct, honesty, background or eligibility to work of any User;
- the quality, safety, timeliness or outcome of any work performed;
- that any Engagement will be entered into, performed, completed or paid for;
- that the Platform will be uninterrupted, error-free, secure or free of defects.
The Platform is provided on an “as is” and “as available” basis. We may modify, suspend, limit or discontinue any feature at any time. We aim to give reasonable notice of significant changes where practical.
Information is provided by users
Profiles, skills, experience, locations, requirements and other details on the Platform are submitted by users. Unless we expressly state otherwise for a specific feature, BLUCLR does not independently verify that information.
Both sides should carry out their own checks before committing to work: satisfy yourself about the other party, the nature of the work, the terms, and any licence or certification the law requires.
Engagements, wages and workplace matters
Any engagement is a direct arrangement between the employer and the worker. Consequently, BLUCLR is not responsible for, and accepts no liability in relation to:
- the terms of any engagement, or any breach of those terms by either party;
- non-payment, short payment, delayed payment or any dispute about wages;
- the conduct, acts or omissions of any user, whether on or off the Platform;
- injury, accident, illness, death, property damage or loss occurring in connection with work;
- compliance with laws relating to wages, hours, contract labour, workplace safety, insurance, social security or taxation, all of which are the responsibility of the parties to whom they apply;
- the characterisation of a relationship as employment, contract work or otherwise, and any consequences of that characterisation.
Availability and technical matters
The Platform is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, secure or error-free, or that defects will be corrected. Features may change, and access may be suspended for maintenance or for reasons outside our control.
Delivery of SMS messages, including one-time passwords, depends on mobile networks and third-party providers and cannot be guaranteed.
External links and third-party content
Our website and app may link to third-party sites and services, such as app store listings. Those services are controlled by others. We are not responsible for their content, availability, security or practices, and a link is not an endorsement.
No professional advice
Content on the BLUCLR website and app is provided for general information about the Platform. It is not legal, employment, tax, financial or safety advice, and should not be relied upon as such. If you need advice on your obligations as an employer or your rights as a worker, please consult a suitably qualified professional or the relevant authority.
Trademarks and third-party names
“BLUCLR” and the BLUCLR logo are marks used by BluClr. Google Play and the Google Play logo are trademarks of Google LLC. Apple, the Apple logo and App Store are trademarks of Apple Inc. Other product and company names mentioned may be the trademarks of their respective owners. Their use on this website is for identification only and does not imply any association or endorsement.
Limitation of liability
To the maximum extent permitted by applicable law:
- BLUCLR, its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, business, goodwill, opportunity, wages, data or anticipated savings, however caused;
- BLUCLR will not be liable for any loss, damage, injury, cost or claim arising out of or in connection with:
- the acts, omissions, conduct, statements, misrepresentations or default of any User;
- any Engagement, its terms, its performance, its termination, or any payment or non-payment under it;
- the accuracy or completeness of any information provided by a User;
- any injury, accident, death, property damage or workplace incident occurring in connection with work arranged between Users;
- any decision you make to engage a Worker or accept work from an Employer;
- unauthorised access to your account resulting from your sharing of an OTP or loss of control of your phone number;
- interruption, suspension, unavailability, delay or error in the Platform.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising out of or in connection with the Platform and these Terms will not exceed the total amount, if any, paid by you to BluClr for access to the Platform in the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, or for death or personal injury caused by our negligence.
Indemnity
You agree to indemnify and hold harmless BLUCLR and its directors, officers, employees and agents from and against any claim, demand, proceeding, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with:
- your use of the Platform;
- your breach of these Terms or of any applicable law;
- Content you submit;
- any Engagement you enter into, or any dispute with another User;
- any claim that your Content or conduct infringed the rights of a third party.
F. Content, intellectual property and your account
User-generated content and the licence you give us
You retain ownership of the Content you submit. By submitting Content to the Platform, you grant BLUCLR a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt (for formatting and display), publish and display that Content, for the purpose of operating, providing, promoting and improving the Platform, for as long as the Content remains on the Platform and for a reasonable period afterwards in backups.
You represent and warrant that you own or have the necessary rights to the Content you submit, and that it does not infringe the rights of any third party or breach any law.
We may remove Content that breaches these Terms, that we are required to remove by law, or that we reasonably consider harmful to Users or to the Platform. We are not obliged to monitor Content, and we do not endorse it.
If you believe Content on the Platform infringes your rights, please write to info@bluclr.in with details of the Content, the right you claim and your contact information.
Intellectual property
The Platform, including the BLUCLR name and logo, the software, design, layout, text, graphics, icons and their arrangement, is owned by BLUCLR or its licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the BLUCLR app on a device you own or control, and to access the website, solely for your own use of the Platform for its intended purpose.
You must not copy, modify, distribute, sell, licence, publicly display, create derivative works from, reverse engineer, decompile or disassemble any part of the Platform, or remove or obscure any proprietary notice, except to the extent such restriction is prohibited by applicable law.
You must not use the BLUCLR name, logo or branding without our prior written permission.
Account suspension and termination
By you. You may stop using the Platform at any time and may delete your account — see Account & Data Deletion.
By us. We may suspend, restrict or terminate your access to the Platform, remove your Content, or close your account, with or without notice, if we reasonably believe that:
- you have breached these Terms, our User Agreement or any applicable law;
- your Content or conduct is false, misleading, abusive, exploitative or harmful to other Users;
- your account is being used fraudulently, or has been compromised;
- action is necessary to protect other Users, third parties, BLUCLR or the public;
- we are required to do so by law or by a competent authority.
Where practical and appropriate, we will tell you the reason and give you an opportunity to respond. Termination does not affect rights or obligations that accrued before it, and the sections of these Terms that by their nature should survive termination will do so.
G. Disputes, law and changes
Disputes
Disputes between Users. Disputes about an Engagement, wages, work performed or conduct are between the Users involved. BLUCLR is not a party to them and is not obliged to mediate, arbitrate or resolve them. We may, at our discretion, provide information we hold where required by law or by a competent authority.
Disputes with BLUCLR. If you have a complaint about the Platform, please contact us first at info@bluclr.in so that we can try to resolve it informally. If it cannot be resolved informally within 30 days, the dispute will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in India and conducted in English.
Nothing in this section prevents either party from seeking urgent interim relief from a court of competent jurisdiction, or affects any right you have to approach a consumer forum or other statutory authority available to you under applicable law.
Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of India. Subject to the dispute resolution provisions above, the competent courts in India will have exclusive jurisdiction.
General terms
- Entire agreement. These Terms, together with our Privacy Policy and our Account & Data Deletion page, form the whole agreement between you and BLUCLR regarding the Platform. They replace the separate User Agreement, Cookie Policy, Disclaimer, Subscription / Payment Policy and Refund & Cancellation Policy previously published as standalone documents, whose contents are now set out in these Terms and in the Privacy Policy.
- Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in force.
- No waiver. A delay or failure by us to enforce a provision is not a waiver of it.
- Assignment. You may not assign your rights under these Terms without our consent. We may assign ours in connection with a merger, acquisition or transfer of our business.
- Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control.
- Notices. We may give notice to you in the app, by SMS to your registered number, or by email. You may give notice to us at the contact details below.
- Language. These Terms are made in English. Any translation is for convenience; the English version prevails.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between you and BLUCLR.
Changes to these Terms
We may amend these Terms from time to time — for example when we add features, or when law or practice changes. The “Last updated” date at the top of this page will change accordingly.
Where a change is significant, we will give notice through the Platform or to your registered contact details before it takes effect, where required or appropriate. If you continue to use the Platform after the change takes effect, you are treated as having accepted the amended Terms. If you do not accept them, you should stop using the Platform and may delete your account.
